
A few weeks ago, Escuela FloreSiendo received word from the prosecutor that she had decided to join the appeal seeking the return of the ayahuasca, Bufo alvarius, kambo, and San Pedro cactus, which they had requested following the dismissal of the unjustified police raid they endured in 2023—a case that was ultimately dismissed in December 2025. The text explicitly mentions ayahuasca and also refers to other substances that are not controlled.
She thus becomes the first prosecutor in Spanish history to agree that the seized ayahuasca and other confiscated natural entheogens should be returned, as they are not illegal in Spain or under the 1971 INCB conventions; until now, prosecutors had opposed this. Furthermore, several judges in courts of first instance had already returned the ayahuasca, and the Madrid Provincial Court has done so on three occasions. This milestone therefore adds to the history of unanimous Spanish case law regarding the innocence of ayahuasca.
